ILR application for ancestry visa holder and spouse

Hi there,

I have been resident in the UK as an ancestry visa holder for nearly 6 years now, and am looking to apply for indefinite leave to remain. My wife has lived here for 4 years, and has held a spouse visa since we were married 3 years ago.

If I apply for settlement using form SET(O), can I include my wife as a dependant? And if the application is successful, will my wife have indefinite leave to remain, or will her visa be restricted in some way? We're looking to start a family soon, so we would like to know if she will be eligible for paid maternity leave.

She is here as a dependant on your ancestry visa, which is not a spouse visa.

Looking back through the details on the British High Commission NZ website, I think you're right. I presume it is safe to list her as a dependent here as well then.

If the application is successful, will she still be listed as my dependant, and will she be eligible to apply for citizenship after a year?
