ILR Application, SOC code, minimum Salary requirement

Post by pnugegoda » Tue Jul 02, 2024 6:18 am

Hi please need an advise for the below query on applying for ILR.
I am a skilled worker under SOC 6121 with a min threshold of £26200. My COS started on 10. 01.2024 and end date will be 09.01.2029. However, I started to from 20.03.2024 according to my appointment letter.
Now according to the IRL min salary requirement what happens when I apply for IRL, if I received a less salary for this year as I started from March and it does not cover this years actual min salary requirement?
Also, my manager approved one week unpaid leave for me visit my home country after 3 years. I had no more than 10 days of paid leaves according to my annual holiday requirement. This will reduce my annual required min earnings again for this year. Usually I am entitled for 28 days paid leaves which includes Bank holidays and another week holiday during Christmas time. I am working in a nursery setting.
Please let me know if the above concerns will be an issue when applying for my IRL. If so I will not take those unpaid leaves as I don’t want to risk my long term goal. Thanks

Unpaid leave (and any salary reductions due to it) under 4 weeks will not affect your visa but your sponsor may have to report this to UKVI. I also do not understand what you mean by 'cover this year's actual min salary requirement' ?? There is no such requirement for ILR

Hi Zimba,

Thanks for the reply. I have heard that i need to fulfill my minimum salary requirement to be eligible to apply for the ILR. I know my annul salary fulfill this requirement. However, i don’t know whether it will be a problem if my annual salary goes down for this year because of this no paid leaves. Thanks

It is about what you are being paid as your base salary, it is NOT about any temporary salary deductions.
