My wife and son got their Tier-2 dependent visa on 09.03.2016. So, both of them were eligible for ILR from 10.02.2021. Their current tier-2 dependent visa expired on mid-August 2021.
Now, my wife and son went to India on 15.02.2021 as my wife was pregnant. We had to travel as she had complications, and she was getting mentally vulnerable. Also, we could not apply for ILR at that time as the priority service for ILR application was shut down due to Covid-19, and normal procedure would have taken 6-8 months.
Now, they couldn’t come back due to Covid situation, and the baby was born in India. I came back from India in April 2021 and apply for ILR in July and got it in August.
Now, their visas are expired and they are now in India. I cannot apply for any visa immediately as I need to first apply for birth certificate and passport for my new-born baby, which is taking longer than usual due to Covid-19.
They have already spent more than 180 days outside the UK in the last 12 months and also their visa is expired.
I am just wondering whether they can still apply for ILR considering her situation, travel restriction due to Covid-19 situation, limited visa services (priority service was closed) etc.
If yes, could any let me know what is the process?
