ILR applied for 9months ago. Can I meet anyone in person ?

Hi Guys,
I am a Bitish citizen. My mother is 64, widow & indian citizen. She also has terminal medical condition. We applied for her ILR as my dependant under compassionate circumstances in March 2007. My MP is involved aswell & has written letter of support. Everytime I call up I get told that the application is "under active consideration". They cant give us any time limit at all.

Now because of her terminal medical illness, time is of essence for her. I have faxed, written to BIA, but I have not received anything in reply to these. Her doctor thinks that very soon her condition will deteriorate & she will not be fit to travel. She has a few wishes which I want to fulfil as her son. We have also found a alternative treatment centre for her condition in the US which might prolong her life slightly & make things easier. I have obviously written all this in my letters & faxes to BIA, but am not even sure if they have read those.

Is there any way I can meet someone from the BIA or HO in person by appt & explain the circumstances to them ? I find this whole secrecy thing very very frustating & cant believe this is the way immigration is handled in a country like UK.

Any ideas or suggestions ?

But can she not come as a visitor in the meanwhile while the HO processes this application. You already indicated that you want to go to NY so if you set it up that she visits and will be leaving soon for treatment, then at least you can get on with the some of things you'd like to do.
I dont think the HO is particular excited to have your mom come and be a drain on the health system. It is a harsh insight about their behaviour but it is better to work around it to be able to conduct your life as much as possible than to keep waiting. I think they are hoping to wait your mom out, its a bit morbid but that is not a quick win for the HO to approve

sory i should have mentioned in my original posting that she is here in teh UK with me. She has been regularly visitng me since 2000. Presently she has 5 yr visitors visa which expires in 2010. But we had to apply for ILR as her medical condition progressed & her doctor gave us a very poor prognosis. So she couldnt live in India alone (even for a few weeks/months) & I had to get her to stay with me not just for 6 months on a visitors visa. So we went to India in mar, got more tests done, confirmed everything & then came here & then applied for ILR.

How long has she been here on a visitor visa?

You can try writing, getting your MP involved, ringing up, etc.

But it may very well not work. You might have to start JR to get anywhere.

As I mentioned earlier, she has been regularly visiting me since 2000. She has never overstayed. Though she has sometimes (more so in last couple of years) reentered UK aster about 1-2 months, again for another 5 to 5 1/2 months. This time we entered UK in March 2007 & made ILR application about 2 weeks after having arrived here.

I have already written to my MP who has been very supportive & has written to Liam Byrne & HO. He forwards me the replies that he gets from them (not much really).

Judicial Review - in this case, JR of the failure to make a decision.

How do I start the process of Judicial Review & what happens after that ? What are the chances of having a favourable outcome with JR ? Or is it better to wait a few more months for the BIA to reach a decision - they might approve her ILR after all & if they dont I can either appeal or say stuff it, resign from my job here & go back to India with my family & look after my mom in her final days.

My understanding is that JR requires quite a bit of paperwork. And a positive outcome is not guaranteed.
The easier option is to wait a bit longer.

Global gypsy is right, it's quite complicated, and a positive result in any legal action can never be guaranteed.
