ILR Apply eligibility - Query

Post by sivakkumarkr » Fri Apr 10, 2015 10:24 pm

Dear Team,
I would like to know if I am eligible to apply for ILR now or need to wait for few months to become eligible. Please find my visa history.

I first entered UK on 30th March 2008(Tier 2 work Permit ). I lived in UK continuously till 4th Jan 2010 then left to India. My (Tier 2 WP) Visa expired on 28th Feb 2010. I applied Tier 2 ICT visa on 10th April (After 6th April 2010 rule change) and then came back on May 2010 with a new Visa (Tier 2 ICT) . Then eventually moved to Tier 1 on 19th on July 2010. Now currently under Tier 1 (extension) which is valid till 29th 2015 July.

Can you please confirm if I can apply for ILR now or need to wait till 1st week of July to apply for ILR.
Also while I was applying Tier 1 i had claimed points for English language using Degree taught in English category. Do i still need to take IELTS or can still submit my degree certificate and claim points.

Also i got married recently and my wife will be joining me in June and she has the visa validity same as that of me, when I apply for ILR, i guess i need to apply with my wife, if i need to apply together , what category should i apply for her. She is currently having a Tier 1 visa dependant valid till my visa end date.

Thank you so much
Kind Regards

you must wait until july

she must extend her stay as a PBS dependant -- does not have to be at the same time but obv before it expires

Category for Dependant

Post by sivakkumarkr » Wed Jul 08, 2015 12:36 am

Dear Members
Thank you so much for always helping so many people on their queries. This forum has really helped a lot and simplified the overall visa application process. I have got a query which i would need your kind help. I have recently got my ILR a week ago from Tier 1 General category. My wife had just came to UK 3 weeks before as Tier 1 dependent. Now having moved to ILR, i would like to know extend my Wife's visa stay to a suitable category. As far as I understand , I need to apply for PBS dependent under Tier 1.
But would need someone's confirmation, can you please confirm if this is the correct application for her. I sometimes think i need to use FLR(M) hence the clarification.

Thank you so much
Kind Regards

Siv

sagareva was correct.

She may fail FLR(M), if her leave was granted for six months or less, as E-LTRP.2.1 fails.
