ILR BRP Card Renewal

Hi Everyone,

I am in a very tricky situation at the moment. Please kindly review this as I am very much nervous :( .

I was granted Indefinite Leave to Remain (ILR) back on 10th July 2014.
My ILR BRP card has now expired on 10th July 2024.
I have made an online application for ILR BRP card renewal on 7th July 2024.
My biometric is going to take place on 30th July.
But I just received a letter on 13 July from County Court. It is a County Court claim form sent to me dated 11th July.
This has been raised by one of my loan company.
I am very much confused about my situation as when filling online ILR BRP card renewal form there was a question about if I ever had CCJ recorded against me. At the time of application I said no as there was nothing like this.
Now I received this letter about County court claim. I am very sad as i am thinking I might loose my ILR status.

There are two things here
I have spoken to my loan company and mentioned to them that I have just received a county court claim but I did emailed them dated 27th june that I will be making payments from 27th july. They admitted that my loan payment arrangement was ackonwledged by them on 27th june and the team who raised the county court claim has not checked the internal notes hence they raised the claim.
The advisor I have spoken to advised that they have seen the mistake from their end and asked me to make my payments as normal. He said someone senior exective from their team will get in touch with me next week to discuss this.
I hope they will say that its a mistake from their end and will take the claim back.

What shall I do here in this very confising situation. Any expert please advice.

-Is the county court claim a CCJ.
-Secondly, if in the next few days if I make the full payment to my loan outright by calling loan company then what shall I do with the county court claim form
- Shall I just make my normal payments as agreed on 27th June by the loan company and wait for their executive team to contact me to discuss about what happened.
-Also what shall I do with the question in my ILR BRP card renewal application online form, shall i mention this or leave it completely as is as CCJ has not been raised against me as I have just received the county court claim form as it stands.
- Shall I cancel my application and then apply for evisa. Although I haven't received an email from the Home Office to register online for the evisa. Maybe I have missed it in junk email or spam which I could not find.

This is an extremely frustrating situation for me.
Your prompt response will give me a relief as I am very much nervous and have no idea what to do.

I doubt that a CCJ is a ground for revoking IlR.

However, if there was a question about it, then, when you attend the biometrics appointment, perhaps you may ask them to add a note about the CCJ. Keep a copy of this addition for your files.

However, as per the loan company they have raised it by mistake and I am expecting a call from litigation team next week.
I am going to ask them to apply to serve notice of discontinuance which I believe they will do when then call me. In that case the county court claim will not be continued and will stop meaning it has never existed.

Please clarify me with this as the loan company has admitted that the payment arrangement was confirmed between us before they send this claim to court so possibly they will discontinue it from their end. In which case as it is not my fault then in theory the claim has not existed.

If it gets discontinued, i believe I will not need to mention this in my brp appointment.

Please clarify this further I will appreciate this.

Really looking forward to a valuable response.

Your concerns are totally baseless. This does not affect your ILR status. The forms often have these generic questions in them which are immaterial to the BRP card renewal. There is nothing in the rules that suggests the ILR is lost if you get a CCJ. Stop being paranoid
