ILR- In my case, i guess i have broken the rule, any advice!

Wish to apply for ILR after 10 years as a student/resident. I Arrived in UK 30th August 1999. Had valid continued stay until 2006 when i was issued with a residence visa. The Residence visa expired on 7th of october 2007, weeks before this, i send by post to apply for highly skilled migrant, but it was declined on 15th of October, thats about a week after expiry of the residence permit. I tried appealing and waited for about 6 weeks in UK, only to realise it takes long before the appeal goes through and was worried if it gets declined, eventually i decided to leave the country and obtain an entry clearance again as a student, i had support from university because i was writing my thesis. I stayed out of UK and entered again on the new entry student visa on 14th of feb.2008. I spend about 6 weeks out of UK as i waited for new visa before re entry on 1 4feb 2008. I guess i wont qualify for the long residence due to the gap of leaving and returning. I left the UK after my residence visa had expired (But Had logged an appeal) and returned on student entry clearance visa and cancelled the appeal. After Thesis writing and graduation, i applied again for a residence visa which is still valid until next year. I guess i have to stay again for another 10 years or what else can i apply for!!! shal i attempt applying for ILR anyway, am ever so worried and frustrated that the appeal process made me to break the continous cycle.
