ILR Dependant - Set LR or O or F

Background:

My wife and I hold ILR (10-Year Long Residence). My son's MN1 application (born in the UK) is pending, while my wife gained ILR after his application was submitted. Our daughter (aged 12) has a Skilled worker dependent visa expiring August 24, 2026.

May I seek the forum to help me find the answers ?

Questions:

Q1. Son's Pending MN1 & Wife's ILR:

Since my wife recently received her ILR after my son’s MN1 was submitted, should I notify the Home Office? If so, what is the best way to do this?

Q2-Q4. Daughter's ILR Options:

My daughter has been in the UK for 10 years and entered as an ICT dependent on 29 May 2016; and presently as Skilled worker dependant since 2021. I am now settled through the 10-Year Long Residence route (while having Skilled Worker visa). Which of these routes is the best/most appropriate?

* Option A: Apply for ILR (Long Residence) since she has completed 10 years in the UK.
* Option B: Apply for ILR via Form SET(O) [Child dependent on a work visa] since I settled while on a Skilled Worker visa.
* Option C: Apply for ILR via Form SET(F) [Child (Family visa)].

Q5. Daughter's Citizenship (MN1):

Since my daughter has been in the UK for 10 years and both parents have ILR, can I apply for her registration as a British citizen under Section 3(1) immediately after she gets ILR, or does she have to wait 12 months after receiving it?

Q1. There is nothing to inform. This changes nothing regarding the MN1 application and son's entitlement to be registered

Q2-4. Any of those applications can be used. The choice is yours

Q5. Under section 3(1), non-UK born children who have lived in the UK for more than 10 years and both of their parents are settled can be registered via discretion. So even ILR for her may not be necessary, assuming she remains with a lawful status in the UK.

Hello Zimba, your response regarding the non UK born children residing lawfully for 10 year's in UK has got me interested.

I got my ILR via set LR on 28 August 2025 (ICT + Skilled worker).
My son, born in the UK got his MN1 approved and now UK passport.

My wife and 2 children, in UK since 29 July 2016, will be eligible for ILR shortly. (visa expiring 16 Aug 2026)

Based on policy for children who are lawfully residing in the UK for 10 years, can I plan like this.

1. Submit wife's set LR in July 1st week, super priority.
2. Submit children's MN1 under section 3(1) after 29 July 2026. (completing 10 year stay).

Would this be a good idea?

Yes, it sounds reasonable. Remember that registration under section 3(1) is always discretionary.
I suggest asking any citizenship related questions in the British citizenship sub-forum instead

Thanks Zimba, sure I'll continue the citizenship query in the other sub form. One question on the ILR itself.

If in case, the mn1 gets refused, will I still be able to apply their ILR after the refusal, given they would have overstayed from 16 Aug 2026 until the refusal?
