ILR Dependent Query - post 9th June 2012

ILR Dependent Query - post 9th June 2012

Dear Admins,

My Scenario :
My Current Visa Category : Tier 1(General) - valid till September 2015 in (2+3 year scheme)
Spouse - PBS Dependent visa issue date : Jan 2013 (In UK but previously on T1 (PSW) & T4)
Children - PBS Dependent visa issue date : May 2013

My ILR Due Date : September 2015

From one of my previous post - I got good information(by vinny) that I can only apply for PBS dependent for my wife and child until they complete 5 years in UK under dependent visa.

QUERY :
Question 1 : Could I apply for their visas from India ?
Because Tier 1 Dependent cost in UK : £1607 (postal) and £2007 (in-Person) whilst in India it is £874 only

Question 2 : I would be moving from Tier 1(General) to ILR before they start making the application. Then would it be possible for them to apply under PBS dependent from home country ?
Would there be any issues taking this route because this would save me £2000 but again like everyone I dont want to complicate the matter just for saving few quids :D

Question 1 : Could I apply for their visas from India ?
Answer :- You can apply from india, before their current visa expires. But there is risk that, Some case workers considers that their ILR period will reset i.e they need to wait again 5 years to get ILR.

But there are success cases, and got ILR considered old stay and new stay (no visa gap.)
