ILR dependents

ILR dependents

1. I was in Tier 2 ICT (Established staff Visa) and completed 10 years on April 3 2021. My dependents were not able to complete 10 years (since they were in india from January 2013 to March 31st 2015). From April 2015 my dependents are with me (i.e by April 2021 they will complete only 6 continuous years in the UK), however they have ICT dependent VISA till January 2023. I got my ILR in October 28 2021 and my dependents are still in tier 2 dependents visa. My query is whether they can continue as my dependent with current ICT dependent VISA or do I need to apply ILR dependent VISA.

Also if I change my company once then I need to change my dependents category to ILR dependent or they can continue with current ICT dependent VISA till 2023.

2. Can I initiate ILR for my kids or do they need to wait till they complete 10 years to get their ILR.

3. I will get my British after one year of stay (i.e. OCTOBER 2022) , then I can apply British passport for my kids or not.

4. Also I want to know the fees for ILR dependent Visa and the duration of VISA if I apply ILR dependent along with my ILR.

Did you get your ILR by Long Residence? If yes, then your dependents (both spouse and children) need to switch to "family member of a settled person" visa. They will all qualify for ILR when the second less-privileged parent does.

When the second less-privileged parent qualifies for ILR, either on Long Residence or on another route.

Assuming the children are born abroad, no. They can apply to be registered as a British citizen when one parent has become or is applying to become a British citizen AND both the children and the other parent have got ILR. Once they have got their registration certificate, you can then apply for their British passport.

Assuming that they currently hold Indian citizenship (based on your profile flag), they will lose Indian citizenship when they acquire British citizenship (i.e. the day the registration certificate is issued).
