ILR - doubt on date of application

ILR - doubt on date of application

Hello, I have reviewed the earlier posts on this group and my query is rather to seek an affirmation on whether my understanding is correct.

My wife and daughter were issued a dependent visa when my first work visa was submitted. All three of us got our visas approved on the same date - 15.Dec.2020, with a expiry date of visa as 15.Nov.2025.

I later changed my job and have a further extension of visa until January 2026. However, to keep the process uniform, I wish to submit the ILR applications later this year together. Also, I wish to take the priority service for all three of us.

Since the '28 day period' is 5 years from the visa application date, this will not commence until 17 Nov.2025, which is 2 days after the current visa expires.

Am I correct in my understanding that I should submit the application for all three of us on 14.Nov.2025, and seek an appointment under the priority service for a date after 17.Nov.2025. That would ensure that the period being counted takes into account the 28 days period before my 5 years period is over?

The ILR application date is irrelevant, you just need to ensure that the decision is made within the
"28-days concession" given.

That means, you're eligible for ILR under the SWV route at visa issue date + 5 years - 28 days. Plan to have a decision within that timeframe and everything will proceed according to the rules.
