ILR doubt

Hi guys,

I entered UK through HSMP in Jan 2008. My visa is extended till Dec 2012. So can i apply for ILR in Dec 2012, even though i will be falling short by 1 month of my 5 year period?

In case I have to apply for extension, will I have to again go through the points system?

If your current leave expires more than 28 days before your 5th anniversary of date of entry in the UK, then you'll need to apply for (another) extension.

Extensions for migrants who applied for HSMP approval on/after Dec-06 changes are subject to PBS qualifying criteria (for extensions). See Tier 1 (General) policy guidance for more details.
