Brief background: I was studying on student visa while working part time in a sales role in 2006. During this time I realised that I qualify for HSMP as I was earning just over £ 40,000 a year while studying. I was granted HSMP in January 2007 and therefore moved from student visa to HSMP visa. After completing my MSc in August 2007 I applied for a Graduate Development Programme position at a reputable organisation and accepted the offer for £23,000. When I applied for extension under Tier 1 General in January 2009 I claimed for just over £23,000. When I received the passport back in the post the documents suggested that even though I claimed points for 23,000 I was given points on the higher banding which was for over £40,000. I think it’s worth mentioning that I just needed £20,000 earning points to meet the minimum criteria of 75 points at the time.
Question: Now since extension in January 2009, I earned around 29,000 in tax year 2009/2010 (as I moved into a sales role again i.e. with good commission but low basic). I then earned just over 43,000 pounds in tax year 2010/2011. On the 9th of August 2010 just before the rules changed for ILR I got a promotion and moved into a commercial analyst role. Although the new role is better than previous I am earning £30,000 as there are no bonuses in this role but instead a higher basic. I will score more than 75 points on 30,000 when applying for ILR in December 2011 but my salary has been up and down because I changed roles. Will this be sufficient to meet the new criteria which I have come across in this forum that my salary should have been increasing all the time or it should be more than the previous earning claimed?
