ILR Eligibility-Days

Hi there,
Initial Tire 1 (G) visa was granted on 14 September 2009.
Date of Entry in UK: 22 October 2009. (after 38 days of visa approval).
I got extension in 2012 till 14 September 2014.

Am I eligible to apply for ILR on August 18, 2014? (exact 28 days before the expiry of my current extension visa even though I entered in the country 38 days after the first visa was granted).
