ILR eligibility for my wife

ILR eligibility for my wife

Hello,

I came to the UK in December 2020, so I can apply for ILR in November 2025.

My wife came to the UK in March 2021 on a dependent visa.

My question is, will I be able to apply ILR for both in November 2025?

If not, what visa needs to be obtained for my wife so that she can apply for ILR in February 2026?

No. She needs 5 years as a dependant. She should extend under 'skilled worker dependant' visa which is a fixed 3-year visa extension

I am on Tier 2 skilled worker visa, and she is on Tier 2 dependent visa.

So when I switch to ILR, her dependent visa will be invalid, right? Am I missing something?

A bit more details if it helps:

My BRP issue date: 18/11/2020

Her BRP issue date: 23/12/2020

Incorrect. Firstly, the Tier 2 route ceased to exist several years ago, it is just the skilled worker route now. There is also no PBS dependant route at all. Secondly, your dependant's visa remain valid until expiry, regardless of whether you get ILR or not. There will be no such visa side effect at all.

The issue dates you provided suggest that you got visas close to each other, so yes she can get ILR with you. You have to wait and apply with her around November, which will be the earliest date of her ILR eligibility (23/12/2020 + 5 years - 28 days).
By that time, you have already qualified anyway. No need for an expensive extension for her.

Thank you for your reply.

I was checking eVisa for end date and noticed that it has a different valid from compared to BRP issue date for both of us.

I am on TIER 2 (General) / Skilled Worker 5-year visa, and my wife is on PBS Dependent / Skilled Worker Dependent visa.

Here is a list of all the dates.

My info:

BRP issue date: 18/11/2020
eVisa valid from: 26/11/2020
eVisa valid until: 19/12/2025
Date of arrival in the UK: 05/12/2020

My wife's info:

BRP issue date: 23/12/2020
eVisa valid from: 06/01/2021
eVisa valid until: 19/12/2025
Date of arrival in the UK: 09/03/2021

Considering these dates, when should we apply for ILR together at the earliest?
