ILR eligibility, redundancy and garden leave

Hi everyone,

I would appreciate some guidance regarding ILR - consultation - redundancy situation

I am currently in the UK on a Skilled Worker visa and working in IT company. I am in current consultation starting 25th June and end of consultation is 9th August and possible redundancy but not confirmed yet.

**Some details about my situation:**

* Current visa: Skilled Worker visa
* Visa start date (on e-visa) : 4 October 2021
* Visa expiry date: 14 Nov 2026

I will be eligible for ILR starting around 6th September.
I have 5 weeks of notice period and 25 days of leave. At this point of time i am not sure if the HR will give the letter stating that i will be working with them in foreseeable future.

What i understand from the HR is that i will be asked to go on garden leave starting if my role gets redundant. I am thinking to proposing that if i take my leaves starting august 9th which would get me into September 13th and postpone my redundancy by a month.

When there was a group consultation, when i asked my HR she told vocally that they will honor my ILR requirement but no email confirmation or any sorts of.

What are the other possibilities? what if they tell me that they will grant a 3 months of garden leave and give me this letter? will it be ok to apply during garden leave? will it be a problem?

Can you please advise?
