Hi,

My name is Vikas and I have a question for which I am not able to find answer till now. My wife came to UK in 2008 on student visa and then she was sponsored by one of the employer in UK. Now, few months back, her employer sponsorship license got revoked and now she is on Tier 2 dependant visa. I am on Tier 2 ICT visa from 19 Sep 2010 onwards. Now, my question are

Is she eligible for ILR after 5 years? She is completing continous 5 years (3.5 years on Tier 2 general visa and 1.5 year on Tioer 2 ICT dependant) in UK in June 2016.
If some employer shows interest to sponsor her on Tier 2 general visa, does all her previous year will go in vein or they will still be counted?
If some employer is willing to sponsor her on Tier 2 general visa, she has to apply it from India (my native country). In that case, will she be eligible for ILR after 10 years? Will all these years spent in UK will be counted in that 10 years?

Sorry for so many questions but I am confused so its worth asking to experts.

No, she needs 5 years as PBS dependent (in a qualifying category) for ILR. Not sure if you qualify for ILR as you came after April 2010.

Starts again from scratch from date of new Tier 2 G.
If some employer is willing to sponsor her on Tier 2 general visa, she has to apply it from India (my native country). In that case, will she be eligible for ILR after 10 years? Will all these years spent in UK will be counted in that 10 years?
Home country yes. If she meets all the requirements to apply for ILR based on 10 years long residence, then she can apply when she reaches that point with a combination of different visas.
