ILR Eligibility

Hi,

I applied for skilled worker visa from inside UK and got approval decision email on 21st October 2022. BRP issue date is 24th October 2022. I then reported a error in BRP within 10 days of receiving it. Got my 2nd BRP with issue date 12th December 2022 as 1st BRP has been cancelled. Can you please answer below queries.

Q1. view immigration status website shows valid from date as 12th Dec 2022. I assume it is updated as per current BRP status. Does it create any problem with ILR as total duration would be 4 year 11 month with this date?

Q2. Which date should I consider for ILR eligibility? Is it the decision email date, 1st BRP issue date or 2nd BRP?

You need to take the earliest date. Visa approval date in most cases is the same as the date on your visa sticker or BRP issue date. However, for administrative reasons, the date of your document could be a later date as a visa or BRP document cannot be backdated. So if your visa was approved last week but the sticker/BRP is produced or printed today, it will have the today's date (that is simply the issue date and not necessarily the approval date). So as long as you use the earliest date, you will be perfectly safe. From the immigration rules perspective, your qualifying period starts from the date of visa approval which may or may not be the same as your immigration document issue date.

You will be eligible for ILR within 28 days of completing your 5 years

Thank you for the reply. I will take earliest start date 21st oct in this case. View and prove your immigration status: get a share code website shows 2nd BRP issue date as valid from date instead of earliest approval or 1st BRP issue date. Is it expected because I use latest BRP to login?

That shows the latest visa you had. This has nothing to do with when your qualifying period starts
