ILR Eligible: Stayed for 4 yrs, returned & came back

Post by parx » Sat Aug 21, 2010 2:15 pm

Hello There,

I seek advice from you all guys regarding ILR. Below is my case

Work Permit Stay - May 2005 - Dec 2006
HSMP Stay - Dec 2006 - Nov 2009
HSMP is valid till Dec 2011
Salary : May 2005 – Jun 2009. From Jun – Nov I survived with my family on my savings.

I had to go back to my country since no projects and hence company sent me back.
While visiting USA I stayed in UK for a day in Feb 2010 and now I am back in UK from June 2010 onwards.

My employer is ready to give me a reference letter stating that I had been to my country on official visit.

Queries:
1. Am I eligible for applying for ILR?
2. In my previous stays I had rented a flat for myself and my family. In this trip I have come alone and am sharing with my office colleagues. Will this affect?
3. During my stay in my country I didn’t receive any salary here? Should This affect?
4. What documents are needed for ILR if I am eligible?

Summary: I had stayed here straight for 4.5 yrs in UK and due to recession I had to go back and come. Will this affect me?

I would humbly request you respond to my queries at the earliest so that I can taken necessary steps.

Thanks in advance.

If this doesn't, what should? Seven months' continuous absence with no economic contribution in the UK.

Not eligible.
Thanks Wandrer for clarifying that.
Is it still the case if my employer gives a letter that I have been to India on official visit . + My dad had Brain hemorrhage during this period.
I didnt want to mention about my dad.. but wanted to know all the options i have.

If the answer still remains , Not eligible then for ILR I have to start over again and my 4 year stay is over-ridden by my 7 month stay in India.

Thanks in advance for replying to this post
