ILR Five Year Requirement

I was going through the documents about Settlement and I found the following bit of information:

Applications that fall short of the five year continuous period
In some cases, applicants may have been granted five years continuous leave, but will not have spent fiveyears continuously in the UK before their current leave expires. Caseworkers may count the period between entry clearance being granted and the date the applicant entered the UK towards the five years, provided this period was not longer than three months.

Does this mean that I will be fine as I am falling short by 52 days as my VISA was approved on 3rd Dec and I came here on 24th January. What do you guys think?

Was your leave granted to complete exactly five years in the same category?

Yes. I came here on Tier 1 and will complete my 5 years in same category

My Tier1 was granted on 3rd Dec 2008 and I came here on 24th January 2009.

In that case you can apply 28 days before 3 December 2013. The period between the issue of your first visa and your arrival in the UK will be included into your residence period
