ILR or FLR for wife and child?

Post by rmew01 » Thu Oct 13, 2011 11:29 am

Hi all

Thanks for a very helpful & informative forum!

I have a couple questions that I'm hoping someone can answer or point me in the right direction.

1) I will be applying for ILR in March, but am not certain if my wife can also apply. She has been a dependent on my Tier 1 (initially an HSMP visa) visa for almost 4 years. But she previously came into the UK on a 2 year working holiday visa (changing after a year to my visa). Can she apply for ILR in March like me or does she have to apply for FLR?

2) Our 1st child was born earlier this year in the UK. My understanding is that she can apply for a UK passport as soon as I get ILR. At the moment she is on my Tier 1 visa as a dependent. Do I have to apply for FLR for her as well, or can I just apply for her British citizenship?

Any help would be greatly appreciated!
