ILR for my child

ILR for my child

I have ILR but my 13 year old child still has LTR (until March 2011) as a dependant of his father who is a WP holder. His father has been made redundant and has not been able to find employement in 4 months. I am extremely concerned!! I have consulted a solicitor who advises that we should apply for ILR for him but it may be tricky as the he does not easily fit into the category of me having "sole responsibility" for him as his Dad does pay maintenance and sees him once every fortnight. The solicitor also advised me that my son should not travel abroad until this situation is resolved. I would like a second opinon, if you like, as to what options I have available and the likelihood of success if I apply for ILR for my son as my dependant. Thanks for your help
