ILR for children born outside the Uk

Post by Dan76 » Mon May 19, 2025 5:19 pm

Hi.
I am very new to this forum and I am seeking some advise. I arrived in the UK with my spouse and children in May 2015 and sought asylum. After nearly 6 years of waiting we were granted leave to remain on the 10 year route to settlement on December 2020 and we have to renew/extend our visas every 2.5 years.

My children were 12, 12 ,10 and 9 years old when we first arrive in 2015. Now they are 22, 21, 20 and 18 years old. Our most recent visa was granted on November 2024 for 2.5 years. Are my children able to apply for ILR on the basis of their private life come December 2025? They were in the UK for a continuous 10 years and would complete a 5 year on a relevant visa on December 2025.

Any advise would be very helpful.
Thank you.

No. All applicants (born outside the UK) for settlement under Appendix Private Life will be required to have or have had leave on the Private Life route for a settlement application to be valid. So your kids cannot benefit from them
