ILR for children(dependant) under HSMP

Post by HSMPnUK » Sat May 10, 2008 8:23 am

Hi all,

I am in HSMP 4th year and my kid is still in India. I am planning to apply for ILR next year.

What happens if my kid joins now? Will he be eligible to apply for ILR next year or should he reside in UK for 5 years for him to apply for ILR?

This question holds good not only for a child(ren) but also for a spouse who joins HSMP main applicant residing in UK at later stages.

Any help or info is appreciable.

Thanks.

Regards,

If they join you as your dependants, then they may be included with your ILR application (196E and 198).
17.18 - Highly Skilled Migrant Programme wrote:Entry clearance requirements for spouses/civil partners, dependent children and unmarried partners of highly skilled migrants ( Rules Paragraphs 194 and 197 )

Prior entry clearance is mandatory

Applications from spouses and children under 18 as dependants of highly skilled migrants should be handled on the same basis as those of work permit dependants (see Paragraph 17.14 of this chapter).
