ILR for children

I wish to know is there is any other category apart from long residence under which children living in U.K as student dependents can apply for ILR if they are living in this country since 8-9 years .

one child born in U.K but he was sent abroad to live with his grandparents.He returned only last year while he other child is living continuously in UK since last 8.5 years

A crucial fact!

For children born in the UK, immediately after a parent is granted settlement/PR, their child is entitled to register for British citizenship (Section 1(3)), irrespective of child's immigration status.

I am going to apply for ILR on Jan 2011 while Dependents becomes eligible on Nov 2011 . our visas are valid till April 2012. Can we all apply together? . What are the options available for us?pls guide

You cannot make a joint application for settlement (e.g. - include dependants in the same application and pay reduced fees for dependants) under long residence.

If you wish to apply at the same time as your dependants then you will need to wait until they too become eligible for settlement. Given that this option will offer no financial benefit, I don't see a point in you waiting.

I share vinny's suggestion that you should apply first as and when you become eligible.

As mentioned above, your UK-born-child doesn't need to apply for settlement. After either parent is granted settlement, he/she will be entitled to registration as British citizen.

Suppose all of us apply separately their long residence applications after completing 10 years and somehow 1 of the application fails to go through
while others are successful so what step failed applicant should take since all three are inter-related(one family i.e parents with minor children).Whether the failed applicant need to go back? pls guide
