ILR for dependants

Post by magic2009 » Mon Aug 17, 2009 10:01 pm

I will appreciate it if anyone can answer my query
I am going to apply for ILR soon (through 10 year long residency ). My wife and child have got student dependant visa at the moment. they have been in the UK since april 2004. what should I do in order for them to get ILR. is it going to be change of status (from student dependant visa to ILR), or something else. what documents I should prepare for this purpose.

Thank you

Hi everyone,

I phoned the home with regards to my dependants and I was told to fill in the set(O) application form in order for my dependants to have ILR, which looks strange to me. because I expected the answer to be either FLR(M), or SET(M).

I just need some clarification here:

I have been granted ILR on the basis of 10 year long residency.
last visa I had was a student visa
my wife and 2 kids are on student dependant visa since 2004, and they are present in the UK.

can they apply straight for SET(M) because they were already on a dependant visa for the last 5 years. or is it compulsory to apply for FLR(M) where they will be granted 2 years spouse visa.

Thank you in advance

My guess would be FLRM.

The reason is that they cannot apply for anything in line with you, so they have to wait for you.

You will be, hopefully, Settled with ILR. In this case they should be applying with FLRM.

Wht not with SETM - they should have been dependants of someone who is British or Settled for 2 years.

So, FLRM is the closest one, I believe.

thank you IMMIGRATION LAWYER

so the time they have spent with me sice 2004 does not count. they were on student dependant visa since 2004, while i was on a student visa.

Now I have ILR.
