ILR for dependent 10 year residency

Post by Linolcy » Thu May 09, 2024 2:50 pm

Congratulations on your ILR success.

Please I'm new on this website and unclear how to generate a new query so I decided to ask my questions here.

My ILR application will be due by July next year under the 10-year route. Since 2015, I have been on a family and spousal visa until recently when my marriage broke down. My employer is ready to sponsor me by providing CoS.

My question is this, will changing from a spousal visa to a skilled worker for a period of 1 year affect my ILR application?

Thanks for your feedback.

ILR (LR) - 10 years route

Post by Linolcy » Thu May 09, 2024 3:13 pm

Hi Zimba,

Please I'm new on this website, so I don't know how to generate a new question, hence, the reason for posting my question here.

I was given a 10 year family route visa in August 2015 under my previous husband and his children as I was taken care of them. This route was given after much battle with the HO.

In 2021, I divorced my husband and remarried and then applied for a spousal visa to which I've been on until now. However, I'm planning to switch to a skilled worker (CoS) via my employer as my current marriage seem to be breaking down due to substance and emotional abuse. I have no strength to pursue my ILR using emotional abuse as it is difficult to proof and I want to move on as fast as I can so I can heal.

Query is this - will switching from spousal visa to CoS affect my ILR application which is due next year July?
My employer is ready to provide my CoS and support pending when I apply for ILR.
Thank you and I look forward to your response.

Apologies @meself2, I felt I didn't elaborate my question clearly...

On 4 Aug 2015 - FLR-FP was granted and I was on it until 2021.
On 4 Aug 2021 - FLR-M was granted and I am currently on this with the plan to switch to a skilled worker.

As advised this change of visa has no effect on the long residence route to ILR

Apologies for coming back with further questions:
If I'm already in my job for 2 years, will it affect decision from the home office?
Approximately how long does it take for decision to be made at the HO? I read it does take approximately 8 weeks.

There are timeline threads and they only serve as a guide, each application is dealt with on its own merit and the turn around time of one does not mean same for another I.e. you can only hope for the best, it takes as long as it takes.
