My sister is disable person (MS since she was 10 years old). Our parents passed away and we have no any other brother/sisters or any other close relatives in our country . Since 1991 my ister was always fully financially depend on me. We were always living together until April 2001 when I’ve moved to UK with my wife and two daughters. I am continue to support my sister financially including 24 hours nursing service. Her illness is progressing and its become almost morally and physically impossible to keep leaving separately.

My family and myself just recently got Indefinite Leave to Remain and we are renting 4 bedroom house.

According to Guidance - Family members (INF 6) (17/02/05) in order to get the visa for settlement my syster needs to complete application form VAF2 –Settlement and satisfy the following conditions:
1.you are living in the most exceptional compassionate circumstances
2.you are completely or mainly financially dependent on children or grandchildren living and settled in the UK
3.you have no other close relatives in your own country to help you
4.your children or grandchildren can support you without needing help from public funds, and
5.your children or grandchildren have enough accommodation, which they alone own or live in, where you can live without needing any help from public funds.

Could you please advice if my case could be treated as exceptional compassionate circumstances ? (Condition 1)

Could you also advise how can I prove financial support during my staying in UK if banking system is not developed in Azerbaijan? (Condition 2)

What evidence required to support condition 3-5 ?

You indeed have a very strong case. You have to collate ALL the documents available to prove that she is your Sister and that she is fully financially depedent on you.

INMHO, there is a 95% chance of succeding so long as you have all the documents available

PS. I recommend that you send a PM to my fellow moderator Kayalami for guidance - it may also be beneficial if you get advise from a competent immigration lawyer
