ILR for dependent

Hi,

Can you please give me some advice. I am on ILR & my wife is on dependent Tier 1 (general) migrant. She has lived with me for more than 2 years in this country. When we had the appointment today (I had used Set M form), they said we have to first apply FLR (M), pay 800 odd pounds to that, then convert it to SET (M) paying 1350£.

Please advice how to proceed.

She can't apply for ILR separately from you while she is on the immigration status of PDS dependant. She needs to apply for leave to remain under paragraph 284 and then ILR under paragraph 287(a)(i)(d). The lady you spoke with is correct and has indicated the correct procedure.

But why did she not apply for ILR jointly with you at the time you applied; was she short of her two years residence at that time?

She did not apply as she had not completed 2 years.

ideally she had to apply for FLR(M)the second or even the same day after u got ILR.
In this case she could get her ILR as ur spouse now.

How would she get her ILR as my spouse? Does she have to fill the FLR first & then SET M?
