ILR for dependent under 2years

Hello everyone,
My initial HSMP visa was stamped on 1st March 2006 and I entered UK on 24th March 2006. I am completing my 4 years in 28th Feb 2010 and can apply for ILR under "HSMP Forum Judiciary Review". Now I am getting married in Oct 2009 this year so just trying to find answers to below queries regarding dependent visa and ILR.

Could anyone advice on below-?

- My fiancée is doctor and I am wondering if she can get dependent visa (in Oct 2010) without the condition of "No work as doctor in training" according to "HSMP Forum judicial review Nov 2008". I haven't got any such restriction on my HSMP visa.

- Can we both apply on same application for ILR (after 4 years in March 2010) as per old HSMP rules as stated under 196E immigration rule on UKBA? Actually she will be here in UK for 4-5 months only but per new rules she can apply for ILR only after 2 years stay in UK.

- Has anyone got or rejected ILR for dependent under similar situation?

- Also my passport is going to expire on 10th Jan 2010. Do you think I should transfer my current visa stamp to new passport first and then apply for ILR?
Or
Will they give ILR on new passport if I provide them old passport (which will cancel in Jan 2010)?
