ILR for dependents - Tier 2 ICT dependent + Tier 2 skilled worker dependent visa

Post by Win2022 » Tue May 31, 2022 9:35 am

Any help/advice will be very useful.

Am switching visa from tier 2 ICT to Skilled worker and will be eligible for my ILR through 10 years route next year. ie Nov 2023.

For my dependents (spouse + child) who arrived in UK Jan 2021.

Does the time spent in the UK as dependents on Tier 2 ICT DV and Skilled worker DV add towards the 5 year ILR route ? ie. will they eligible to apply for ILR in Jan 2026 ?

OR

Do they need to spend 5 years after I receive my ILR, and have to be as dependents under the FLR (M) before they can apply for ILR. ie will they eligible to apply for ILR say mid 2029 ?

Thanks.

They cannot apply for ILR based on 5 years residence if you get ILR based on 10 years long residence. They will have to switch to FLR(M) spouse/child visa and your spouse will have to meet the English requirement and you will have to meet the £22,400pa financial requirement.

Yes.
