I need advice on below please.
We arrived in UK in May 2018 (myself with 2 kids) and my youngest was bron in dec 2018(completed 7 years just last week).
Right now our visa status is rejected private family route visa awaiting date of Tribunal appeal.(this case was submitted in 2024 basis my older 2 kids completed 7 years in UK, they r under 18 and I am single parent of my kids since we arrived, the reason of rejection was that "date of application submitted was less than 7 years of stay while date of decision was 4 months over 7 years of stay because HO took 9 months to reply).
Question 1. Can I withdraw my youngest son appeal and apply his ILR( is it possible to withdraw 1 dependent application?).
If so then what are his chances of ILR as we hv overstayed on our current visa because of no reply came in time from home office for private life route applications and now in appeal so we r ,I assume , overstayed. What are his chances of getting ILR.?
Question 2. In case he is granted ILR, can I apply for myself for his guardian visa, being single parent of minor. What are my chances, again ,overstayed, suitability clause is what is fearing me again and again.
Or there can be any other options available for me? Kindly help me I am quite worried about our visas now due to chances of suitability.
