ILR for Pre nov 2006 HSMP

Hello,
I am a silent reader of this forum. I come under HSMP judicial review as I have got my HSMP on september 2006. I would like to know whether I am eligible to apply for ILR on september 2011 since I would have reached 5 years by then. I know that I donot need to take Life in the UK test for ILR and also to get ILR there is no income threshold or points to qualify. Kindly correct me if I am wrong. Wishes for xmas and Happy new year 2011.
