Dear Senior Members and Friends,

Thanks for looking this thread.

I have got 2 queries.

1) I am eligible for ILR end of this month (1 year work permit+ 2 yrs HSMP (April 2007) + 2yrs on tier-1 general). My wife and my son are my dependents and both of them are in India as we are expecting a baby.

We got married in Sep 2008, with the 1st pregnancy she was out of country for 8 months . Now she is away since January 2011 (totally she was away for 13 months out of country in 32 months)


If I get ILR in UK, will they have to apply as a dependent of a settled person (with new born).

After 1 year of my ILR when I apply for Citizenship, I believe my kids will get the same as they are <13 years. But my wife will not be eligible although we will married for 4 years but not lived continuously together.

Am I right?

2) If I postpone my ILR application (as visa only expires April2012) till
they return to UK (Nov2011),

Will my dependents get ILR?

Or

Dependent of a settled person?

Can I include all dependents and apply in person…..

Confusion for me here is get ILR in UK +get dependent visa for dependents in India OR apply when they are back.
Sorry for a long post…..

Please feel free to share your experience if you had similar situation.
