ILR for Tier 1 General Dependets over 18

Post by khan10200 » Sun Sep 25, 2011 12:51 pm

Hi,

I am currently on Tier-1 General Visa. I will be completing 5 years of continuous residence and will be applying for ILR. I have four dependents, a wife and three kids. By the time I will complete 5 years of continuous residence, my dependents would had completed more than two year of residence and hence would be eligible to apply with me. By the time I will be able to apply for the ILR, two of my children would be over 18, although they were under 18 when they were granted initial leave to enter couple of years ago. All of their visas are Tier-1 General Dependent.

I was looking thorough the application forms and learned that SET(O) is the appropriate form for this purpose. But the guidance and the form itself says

"You and your partner and/or children under 18 if they are applying as your dependants (if allowed by the relevant immigration rules - see below).“Partnerâ€

SET(O) should be okay.

SET (O)

I am confused how SET(O) will be filled for dependent child over 18. It has section for main applicant, and then for dependents where only under 18 is allowed. When my children over 18 will fill this form in, would they fill the main applicant section or the dependent section only leaving main applicant sections empty? Remember they are dependents not the main applicants
