ILR for Tier 2 General

ILR for Tier 2 General

I am VERY confused with how requirements for ILR works. I hope some of you guys can enlighten me.

I was employed here in the UK since July 2011 and have a Tier 2 General Migrant visa. Currently I am on my 3rd year but have already re-newed my Tier 2. This visa is effective until 2017.

On 2016 (my fifth year), I intend to apply for ILR. I am not making £35,000 with my current employer. However I understand that it's either I am paid the appropriate amount OR I earn £35,000. Under Appendix J, it states the following under the criteria of a NURSE:

Band 5 and equivalent: £21,388
Band 6 and equivalent: £25,783

I am able to meet Band 6 requirement as a Nurse. Does this mean I can apply for ILR? Or do I still need £35,000 per annum?

Yes, you will need to meet the £35,000 unless your job is on the shortage occupation list.
