ILR for Tier1 General query on eligibility

Post by amonty » Fri Jun 03, 2011 3:20 pm

Hello friends,

I wanted to know if I would be eligible for ILR under the new rules for this year. Just curious as to which one date should I use as "last grant of entry to clearance". I got my Tier 1 general stamping of 20 April 2009 and I have been earlier on a employee sponsored work permit. Since I am only a Bachelors holder I would have lost out on the 30 points for my Tier 1 consideration. But because I applied to Home Office in mid March 2009 (before the Tier 1 rules for education changed) I did get the 30 points. But now I am coming up to my ILR application stage so have question will they consider my Bachelors.

In the new rules I understand that the 30 points for Bachelors are not given to individuals whose last grant of entry clearance on Tier 1 general was in between 31/03/2009 and 5/04/2010).

Should I take my last grant date as 20/04/2009 or will this be the date my Tier 1 was filed which would be mid March 2009? Is there any way of knowing the last grant date from Home Office?

Kind regards,
Monty

If you read the form carefully, you'll know the answer. Alternatively, see Latest Set (O) - Conflicting language for Bachelor's Degree.

Thank you for taking time and responding to my query. But I am still confused. Do I get the 30 points or I dont?

In the link you mention that if some one got the Tier 1 stamping after the 31st March 2009 they will not get the points for Bachelors when they apply for ILR. So am I correct in assuming I DONT get the points right? Apologies for asking again as the form and the whole ruling change is all quite confusing.

Regards,
Monty
