ILR from GTV, When did you first enter?

Post by imalo » Thu Jul 03, 2025 4:59 pm

Hello,

I am confused how to answer the "when did you first enter the UK" question.

I started work in the UK on a GTV in Sept 21 but resided with my parents outside the country until finally finding a place to rent and moving to UK in June 22.

I have thus given this absence for that period in the "did you ever live in a different country" section. And therefore entered June 22 as the first arrival to count the continuous presence from.

Is this correct or do I need to state the entrance as Sept 21 (I did physically enter but did not yet take up residence) and count the time with parents in the absences section?

Thank you for your help!

The answer to that question is not important at all. Your eligibility is not determined by that at all. Do not invent your own definitions regarding residence in the UK, as they do not have any basis under the rules. You only need to declare absences covering the last 5 years, after you entered the UK. The 5-year qualifying period under your route is counted from the very first visa issue date.

Thank you for the response.
To be clear, you are saying I can leave it the way I have it, setting first entrance as the start of my residence, rather than the date of the GTV being first issued/work having commenced. I only need a 3 year presence for ILR as it is a GTV route.

Yes. Again, the date you entered on the form is irrelevant for calculation of the qualifying period. The qualifying period is evaluated as per the rules. If you qualify after 3 years under GTV, then they count that from the date of ILR decision and backwards.

Thanks for clarifying, now another question has come up. They ask if I have ever lived in a different country while, so that means I have to give my entire history of which countries I have lived in from birth? This the time with parents before entering to continuously live in the UK goes as the last one in this category?

That's exactly what countries you've lived in means. Not countries you've visited, but lived in. With parents, cousins, uncles, aunties, by yourself, with spouse. They all go on the list! This the time with parents before entering to continuously live in the UK goes as the last one in this category?
No sin in failing, you just have to try and try again!
