ILR - Have not been living in UK

Post by arabib » Sun Apr 17, 2011 12:56 am

Hello,

I am an Australian citizen who was living in the UK until june 2010 with my civil partner who is British.
I have had my FLR status since November 09 however my partner and I decided to live in Australia from June 2010 as mentioned.

I will be traveling back to the UK in a few months and wanted to know if it was possible to apply for ILR if I have not been residing in the UK

I understand it would not make sense with the title of 'Indefinite leave to Remain' however if this is not possible then what are my visa options each time we travel back to the UK? We are looking to remain in Australia (as the weather is too good to leave) however things happen in life and I want to ensure I will have no issues in the future should I lose my FLR status.

Sorry If I have confused you :-0

Thanks,

B
