I am a newcomer and having gone through the posts and FAQs have found it most useful.
My query is regarding Q32 part 2) which states the following:
Q32 - When should I consider including my UK-born child in my settlement application?
Under the following circumstances:
1. - If your UK-born-child had applied for leave in the past which is due to expire before you can expect a decision on your settlement application and you have reason(s) to believe that your settlement application may be refused. Including the child in your application will ensure that the child gets the same appeal rights as you do.
2. If you wish to travel abroad with the child soon after you receive settlement and do not have the time to apply for child's registration and British passport (and receive these documents) before you travel.
A little background info about me might help to answer my query:
I am on a Tier 1 General visa and am eligible to apply for ILR in June 2014, which I plan to attend the premium service along with my husband who is my dependent. We hope to be granted ILR status as there is no reason I see for refusal. I also have 2 children, both born within the UK and who also hold dependent of Tier 1 status which is valid till September 20th 2014, but we are planning to apply for naturalisation for them once my ILR is granted.
I was led to believe from a friend that after we apply for naturalisation for them (for which we do not have to submit their passports) , it would be okay for me to travel abroad with the kids as they would have a valid entry permit as Tier 1 general dependents till Sept 2014, and the fact that I have ILR already shouldnt affect them. We were planning to travel from mid-July to mid-August and hopefully once we returned and the naturalisation process was approved, they would get their British passports.
However, reading the above statement in your FAQs, I am concerned that there might be an issue for my kids when we re-enter the UK, in which case we would have to either not travel until they get their passports, or then apply for them as my dependants as well when I apply for my ILR. However, this would involve a considerable extra cost.
Please could you clarify the above for me, I would be most grateful.
