ILR application - end of 5 years or when BRP expires?

Post by BobaF » Wed Jul 27, 2022 8:44 am

Hi, a quick question if anyone can advise?

My wife is nearing the end of her second FLR and will be applying for ILR.

The dates on her BRPs are as follows:

First FLR BRP: issued 20-11-2017 valid until 20-5-2020

Second FLR BRP: issued 26-5-2020 valid until 10-12-2022.

When applying for her ILR, do we need to apply before 20-11-2022 which is 5 years since her first BRP was issued or do we have until 10-12-2022 which is when her second BRP expires?

Thanks for any help!

Between Sunday, 23 October 2022 and 09-12-2022 should be okay. Applying anytime in November is probably easiest to remember?

ILR - Income from self-employment in the last financial year

Post by BobaF » Tue Oct 25, 2022 9:33 am

Hi, I'm hoping someone can advise. I've searched here but couldn't find a clear answer.

I am a director of a limited company and am paid a salary and dividends.

My wife is currently applying for ILR and one of the questions is:
"What was the income (in gbp) from self-employment in the last financial year?"

It says to use the profit figure not turnover but then mentions to take the figure from SA300 or SA302 forms, which is self assessment not the company profit figure.

Question is - do I use the company profit figure from the CT600 or do I use the self assessment income figure?

Many thanks for any assistance.

There is a whole guide on this: https://assets.publishing.service.gov.u ... .0-ext.pdf

Company directors are NOT necessarily self-employed. This is a common misconception. However, in both cases, you need to file self-assessment. If you are not registered as self-employed with HMRC, you must rely on your company tax year and ignore the normal tax year period. You will need to submit CT600 rather than the self-assessment.

If you are yet to produce an account, then you cannot use your current income from your company towards evidence of finances and you may fail to satisfy the requirements under category F or G.

Thank you Zimba. Yes there is a whole guide on this but it does not answer my question.

I have accounts. I have a CT600. I have my self assessment.

The ILR application asks for income from self employment in the last financial year and I have ticked the box that I am a Director of a Ltd Company.

It says that the figure must be profits not turnover which means they are asking for the figure from the accounts, but then says to use figures from the self assessment which is NOT company profits.

You must provide the documents required as per immigration rules. The form is NOT necessarily accurate :!:
The information you enter on the form is NOT used to make a decision, the information from your documents will be used. Answers on the form simply help guide the caseworker
