hi everyone,
i am on work permit for last 4 years 10 months and next month i will have to apply for ilr,i am completing my qualifying period on 26th may,2011. i came in june 2006 ,2011
i am a chef ,and working for the same company for last 5 years,and my salary doesn't meet the requirement under the new code of practice.my salary is £7.5 per hour and requirement is £8.45.
could anyone plz tell me that .... are these rules applying to work permit holders.
i'll really be grateful for your help.

134. Indefinite leave to remain for a work permit holder wrote:(iii) he is still required for the employment in question, as certified by his employer; and
(iv) his employer certifies that he is paid at or above the appropriate rate for the job as stated in the codes of practice for Tier 2 Sponsors published by the UK Border Agency,
But, this is a recent case of settlement approval of someone who was perhaps in a similar situation. Details of how / why approval was granted is yet unknown.

Request your employer to increase your salary to the required level at the earliest ... to enable you to be in possession of at least one payslip that shows that you are being paid at the appropriate level.
