can i apply ILR on basis of 10 years legal residence 20 days before i reach the 10 year mark?
eg .. 22 oct 2007 will make it 10 years for me and my visa expires on 02 oct 2007? so i can i apply on the 01 of oct 2007 or i need to apply after the 22nd?

I think, you can safely apply and get ILR if your 10 years of stay has all been legal in this country (i guess it has to be without time breaks as well!).

If your current visa expires on 2nd Oct 07, wny not apply 28 days before and have a safe margin and get your ILR approved?

I think you are safe here, but do wait for others like John et al to confirm this.

The usual worry about these safe time gaps is on 14 years basis for ILR, where it is correct to first wait and complete 14 fuill years before applying.

For legal 10 years stay, you should use the 28 days rule.
