ILR next month.. need advice

Hi all,
I am applying for ILR next month and I need some advice. I would be very grateful if some of the senior members can reply and try to solve my concerns...

Here is what the situation is:

Sept 2002 - October 2006 - Student Visa
October 2006 - HSMP stamped - 2 years
October 2008 - Tier 1 extension granted - 3 years (Under JR)
October 2011 - Applying for ILR...

1. Applied for HSMP in 2006 - Approved in Aug 2006. Stamped Oct 2006. At this stage I was working part time with a company as a freelancer (on a student visa)...i know i shouldnt have been doing that - i realised that afterwards. Silly me!

2. This company has somehow not paid my tax during this period. So when I called HMRC they could not trace anything paid in for that period - 2006-2007. This company is now not trading...and i cannot get in touch with them.

3. In April 2007 I went permanent with a company and since then until now, I have all legal papers - (P-60s, bank statements and payslips).

4. Now I am applying for ILR and have 4 P-60s(2008,2009, 2010 and 2011) and no P-60 for that period in 2006-2007. I have some bank statements that show that company paying money into my account as salary...

*Question: Is it ok to show my bank statements from Oct 2006 - April 2007 as I do not have P60s or payslips for that period.
The HMRC letter states that there is no indication of tax paid in that period...?

I hope this is not too confusing. Please advice me on what documents I should show for my application...
If you have questions please ask and I will try and clarify...

I am worried, please some one advice me on this situation...

working as freelance it was ur responsibility to pay tax to HMRC,not the company's( in majority cases)

My apologies..What i should have mentioned is that it was a contract.. I was on the pay roll of this company and they raised invoices on my behalf.. So I assumed they deducted the tax and NI for me before paying me...

I guess i should have checked all this at the time. My bad. :( But in my current situation what would you suggest I supply as documentation when I apply next month.. Please advice...

as u r covered JR u have to proof that u were economically active.
It is not necessary to pay tax(ur wages might b lower of the threshold liability for the tax).
Find any papers prooving that u were working or doing smth.to b economically active

As I mentioned above, I do have a bank statement from that company showing money being paid in with the company name showing on the bank statement.. So would that be ok to show for that period then?

Try to trace their accountant or may be they trade under another name - to get just a letter from them stating that u worked for them(u need a simple letter)

Is it important to have all 5 P60's

May I please know, how to request the P60 or record from HMRC for Year 2007, what do i need to ask, I have not got one for 2006-2007

But i do have 4 P60's (2008.2009.2010.2011) and ILR is due in 2012 January

Please advise

Hi Fora, As i said before I shall try and locate the old company.. That wasn't fruitful. :(

But I contacted the company I was contracting for through this company that has closed.. They have found records of transactions that they are willing to print out in excel sheets and attest those for me.

These would prove that invoices were raised by Eksper technologies (my umbrella company - now closed) to this client and that payments were made back to them.

The finance guy said that it would take over 2 weeks to look through physicial records int he archives to locate the actual invoices that were raised way back in 2006-2007. And that they are probably not even sure if they physical records are in the same building... :(

Do you reckon I can show this sort of letter with the list of transactions for invoices or would i need the physical invoices.. ? :(

Please Advice...

get as much as possible. at least u will have the attested letter. if u get the invoices -that's fine. If not, i think their letter will b OK.

Thanks Fora! for your reply. I will request them if they can spare some time to locate the actual invoices and if they are reluctant to do that,(which he sounded on the phone), I will settle for a letter as he did mention it will include, invoice details, dates, amounts etc... and it will be stamped and signed...

Ok cool! will do.. He did mention it will be a formal letter stating Client name and my Umbrella company name and the list of transactions between the periods I ask of them... it will include amounts for each invoice and details.....

and signed and stamped!

I think they are helpful cos I went permanent with this company from April 2007 for the next 3 years...They have always been good to me....
