ILR Partner, children visa and maintenance

Hi,

Recently I have been granted the ILR (10 Years route). Before that I was on Tier 4 Dependent.

My wife has a Tier 4 Student visa and my children are on Tier 4 dependent. Now, I would like to extend my wife's and my children's visa but I don't know which category they have to apply for.

Also, do they need to meet requirement for maintenance (if any).

Hope someone can enlighten me on this matter.

Additional info.

My wife was granted Tier 4 Student on January 2012 and before that was on my Tier 2 General dependent. The category changes was due to me resigned from the job.

My children was granted Tier 4 Dependent Child on Jan 2012 and before that was on Tier 2 General dependent. Both of them are born in the UK (but they are not British).

As your children were born in the UK, you do not need to apply for further leave for them, they are now entitled to register as British by virtue of section 1(3) BNA on form MN1 as you've been granted ILR.

Your spouse can switch to FLR(M) before her current leave expires, for which there is a Financial and English requirement. Settlement would be in 5 years (2x 2.5 year FLR(M)) or when she has 10 qualifying and continuous years.
