3 ILR queries - Please help me!!

Post by bsgvm » Sat Jun 21, 2014 9:19 pm

Hi Gurus and mods,

First of all, Congrats and BIG thanks for this wonderful forum. I'm on Tier-1 General, going to apply for ILR soon. I've gone through various posts and FAQ and still have 3 doubts.

Appreciate a lot if you could reply my below queries:

1. In set(O) form, for 5.3 (Page 17), the question as follows:

If so, what is your pay each month after income tax and other deductions?

My query: I don't get same pay every month as I did a lot of overtime last year to match up my salary to a considerable value in order to claim better points in the Point based system. My actual salary is X amount and including overtime it goes to 2X sometimes. How much pay should I mention here as amount? average of last 12 months?? or my actual net salary without any overtime??

2. For 6.3 What evidence has been provided to support the reasons for all absences from the UK?

My Query: I don't have letter from employer. Can I prepare my own excel worksheet of my absenses with reference to Passport page numbers (where I've immigration stamps)? Appreciate if there's any approved template/sample available in this forum which I can download and use?

3. On page 66, 11L, there is something like "For the period before you were granted leave as a Tier 1 (General) migrant, documents showing that you met the relevant requirements of the immigration rules." with a check box.

My query:What documents are they referring to? I initially came to UK on Tier2 - Inter company transfer visa and after 9 months I applied for Tier 1. I've calculated my 5 years duration based on my first day landing here in UK.

THANKS!!

1. This is your base salary. This is what should be in your employment contract. Overtime, subsidies or allowances are temporary and do not count towards your annual salary.
This is only used in assessing the applicant’s financial capabilities e.g. whether you can pay your home rent or expenses etc. This do not count towards the salary points.

2. This question has been asked a few times. From the past experience, people have applied for ILR without employer’s letters, only passport stamps and they have been successful. Try your best to get the letters, if not then passport stamps should suffice.

3. Sorry I am not able to answer any queries related to Tier 2.

Good luck.
