ILR Query - overdraft

ILR Query - overdraft

Hi all

My husband is South African and currently residing in the UK with me on a 2 yr spouse visa (since Oct 07)

In Sept 08 he is due to apply for ILR which we are confident of getting already; we have plenty of documents in both of our names and individually to our home address.

The only thing I am worried about is since Sept 07 up until end of April 08, we were using out overdraft facility.

I am concerned about providing bank statements from these months as they may raise eyebrows, at the same time I’m unsure whether to just provide them because they show us as overdrawn.

we are not using our overdraft facility anymore and don’t intend to again for a very long time so when we provide the rest of our bank statements since April 08 they are all "in the black" and everything's OK.

I would be grateful if someone could advise me if providing these statements with us overdrawn will effect our ILR application, or would it be wise to not provide them and make up for them by using other documents/letters/bills etc from this period?

I wouldn't worry about your statements being overdrawn. ILR is given provided that you can prove your are still living together in a genuine and subsisting marriage and that it was not one of convenience.
The documents you provide help to prove that you are living together as all correspondence is addressed to either of you at the same address.
