ILR-Query

Hi,
I and my husband, both are currently living in UK on tier 1 visa (not dependent). I’ll be eligible to apply for ILR in October 2011, but my husband is here only for 2.5 years. We are married for 2 years now, but only recently (for last 3 months) started living in the same address.

So my question is can my husband apply for ILR with me as a dependent?

No, I don't think so.
He hasn't lived with you in the UK for at least 2 years. Nor does he have leave as your partner.
So, 319E is not satisfied.
