ILR question help appreciated ****UPDATED*****

Ok the time has come for hubs to apply for his Indefinite leave to Remain visa based on our 2 year marriage. From the date the first FLR visa was granted in oct 2003 to Jan 05 we lived with my parents so we dont have any utility bills in our names but have bank statements credit card bills letters from inland revenue plus alot of invoices from amazon.co.uk british airways etc that do cover us for for that period of time. we moved into our own house in jan 05 so we have utility bills etc but im worried about the first year although we do have alot of letters etc from the estate agents from hubs accountant will this be enough? The utility companies where not willing to put us on the accounts when we lived at my parents house.

We are including both his and mine payslips I only earn about 400 per month and Alec earns 1900 we have about 3000 in savings is this enough? We will also include bak statements.

I am also pregnant with our first child and was wondering should i write that on the application form as another "proof" of the marriage being genuine lol!!

I simply must respond to my namesake :lol: ....amazing how time fly's....has it been 2 years already.

1. SET(M) lists other documentation pertaining to subsistance of a marriage not restricted to utility bills. Include NHS medical cards, payslips, DL and other official correspondence addressed to you while at your parents house.

2. Include a letter from your parents confirming the details you state with evidence of home ownership and utility bills in their names.

3. Your spouse if he has resided in the UK for 3 years at point of ILR grant may apply for naturalisation as a British Citizen. NI has a distinct police service - he is best to get a police clearance certificate to include in his naturalisation application in support of character requirement. This could take up to 40 days.

4. No harm in including pregnancy details - GP letter with confinement date should do.

5. Presume you are a resident of NI and have been for last 3 years. Your child taking into account amendments to the Citizenship Act (to replace Good Friday constitutional agreement) is eligible for dual British/ Irish nationality.

5. Your funds very o.k. - don't forget to submit mortgage docs though.

Hey Kayalami!!

Thankyou for the response you helped us with the fiance visa and now 2 years later you are helping us with this really apreciated!! Your right time does fly it doesnt seem like a minute since we got married now we are celebrating 2 years!!

We have the NHS cards, Inland revenue letters Bank statements etc etc for the time we where at our parents house I was just kind of worrying about the lack of utility bills but we have those for our new house plus the mortgage papers in joint namesso Im guessing we should be ok I have made up a bundle of about 30 documents spanning from our parents house to current date.

Alec has lived here approx 2 years 5 months so it doesnt look like he can apply for British citizenship straight away. He isnt sure even if he wants to because of now having to prove he can speak english and take the citizenship test. As you rightly point out I being a citizen of Northern Ireland have both an irish and a british passport so when we reach 3 years marriage he is going to apply for an irish passport because there is less hassle!No english tests no citizen tests but I guess there is no harm for him to have both irish and british passports.

Thanks for the congrats on the anniversary and baby I have a letter from the hospital about the pregnancy but I cannot send it with my application as I have an appointmemnt to attend on the 21st Oct and hopefully Alec's ILR application will be well on the way for approval by then!

Alec is self employed but on a regular salary each month he doesnt recieve payslips as such but the company he contracts for wire transfer him money into our account each month. He recieves from the bank a letter confirming the transfer plus the contract numberI have included prrof that he pays his taxes and national insurance documents.

Nice to see you still around here and still helping others such as myself really appreciated.

Hey everybody specially Kaylami!!

We posted Alec's visa application on the 3rd October (Our 2 year wedding anniversary) by special delivery and it arrived back today with ILR visa granted so just slightly over 4 weeks via post and quite a bit cheaper lol!!

We where slightly concerned by the lack of utility bills we had for our stay in my mothers home but we included any piece of post we could find amazon bills, inland revenue letters, you name we included it then for our new address we included more official items electric bills, phone bills, mortgage statements etc. We also included 6 months worth of payslips for both of us plus 3 months of recent bank statements. If anyone has any questions regarding ILR via marriage I will try and help I lurk here quite often :)

Kaylami one question if Alec wanted to become a british citizen I would assume he would apply around 9th of May 06 as th he first came here on the fiance visaon the 9th may 03? I read you have to be here 3 years as the spouse before you can apply for BC? He is thinking he may as well hold British irish and romanian passports :)

Congratulations on your ILR....christmas is well early for you :lol: . Suggest apply for naturalisation on or after 10 May 2006. This covers the 'must have been in the UK/physical presence' 3 years ago from the date the Home Office receive the application. Might be worth your spouse looking into doing a citizenship test before May 2006 so this is out of the way. Of course you may call the child Kayalami :lol:
