ILR 10 YR, rejected. Should i reapply?

ILR 10 YR, rejected. Should i reapply?

Hello, posted on another forum but need a quick aswser.

A few facts....
1. All visas have been issued in th UK.
2. I always sent my application 1 calender month before expiry and only went in person once, unfortunatly I cannot remember when it was.
3. I've spent less than 6 months in total outside the UK in the last 10 years.

20-Jun-2001 ------------------------------ 30-Sep-2004
08-Feb-2005 ------------------------------ 30-Nov-2005
07-Dec-2005 ------------------------------ 06-Dec-2007

My application was rejected coz of 2 gaps;
1. 31-Jan-1997 to 13-Aug-1997.
Made my application early Jan 1997 but did not have document from future college.
HO was fully aware and held my application until Aug when it was returned and i reapplied Immediatly after.

2. 1-Nov-1999 to 18-Nov-1999
Again made my application early in Oct 1999 but did not have all my University documents.
I was in year 2 of university then. HO was fully informed and held my application until i sent the document.
Moreover the stamp was issued on the 18 Nov 1999, I'm sure this was a postal application how then can they call it a gap?

So, should I reapply by post or put my evidence together and pay them a visit in person? in which case what evidence would be suitable? I'm time restricted and waiting for my HO file will jeopardize important plans i need to make.

Nekh:

Sorry for the state of your application. It seems though the HO extended your visa during those two occasions, their system considered that as a gap.

Going in person won't help your case but rather would meet the same fate. What you want to do is to make a request under the Data Protection Act to the Subject Access Department. With your file in hand you can then know where the problem is and then write a detailed explanation and apply by post.

Google this board under "SAB" or the BIA's website and you would get info on how to go about this.
